Dodik: The Law on Immovable Property will enter into Force Today

An appeal has been submitted to the Constitutional Court of Bosnia and Herzegovina to determine the constitutionality of the Law on Immovable Property Necessary to Perform the Function of Public Authority of the Republika Srpska.

BiH Presidency Member Milorad Dodik stated that the Law on Immovable Property of the Republika Srpska, which is used for the functioning of public authorities, will enter into force today and that it is the obligation of all bodies in the Republika Srpska to act accordingly.

“Our` Official Gazette` will publish it. It will come into force, “said Dodik.

Dodik emphasized that no decision of an individual will and cannot stop that, “especially such as Christian Schmidt, who did not get the consent of the UN Security Council and does not have a mandate.”

The appellants expect that the Constitutional Court of Bosnia and Herzegovina will do the same as in several previous decisions on property, in the near future on forests and agricultural land – declare the entity parliament incompetent to pass a law on property status of state property.

“All those who think that they can solve it in another way, should understand after six times that this matter does not go differently and sit down with those who are their partners in the Parliamentary Assembly of BiH and agree. And the Constitutional Court, one day Mr. Mato Tadic said that no one said whose property, whether entity, state, etc., the only authority to regulate the issue is in the Parliamentary Assembly. ”

The High Representative in BiH, Christian Schmidt, suspended the Law on Immovable Property of the Republika Srpska, which is used for the functioning of public authorities, and which was adopted by the National Assembly of the Republika Srpska on February 10.

On April 7, the President of the Republika Srpska, Zeljka Cvijanovic, announced the decree on the promulgation of this law, which will enter into force today.

The issue of state property has never been resolved. Commission for State Property of BiH Parliament, while in office, did not propose criteria for determining ownership. In addition to the suspension of the law, Schmidt extended the previous law on the temporary ban on disposing of property, until this issue is resolved in the BiH Parliamentary Assembly. The Embassy of the Russian Federation asked the Steering Board of the Peace Implementation Council to annul all new decisions of the High Representative, whose legitimacy the country does not recognize.
