Dodik: We will not go to the Prosecution of BiH, there is a Risk of unpleasant Scenes

Republika Srpska President Milorad Dodik said that neither he nor other officials from the RS who have been summoned to the Prosecutor’s Office of Bosnia and Herzegovina will go to the hearing because, as he claims, there is a possibility of causing unpleasant scenes in the event that the prosecutor orders their detention.

“They want Radovan Višković, Nenad Stevandić and I to appear there to order our detention. We believe that ordering detention would be dangerous because the Serbian people here would rise up and unpleasant scenes would occur,” Dodik believes, Srna writes.

He accused the Prosecutor’s Office of BiH of abuses, stating that “this is the best way for it to fail.”

“It will not be able to operate in the territory of Republika Srpska. A law has been passed that will prevent that,” Dodik said.

According to him, he went to the trial in Sarajevo “believing that there is at least a per mille of professional legal relations.”

Dodik recalled that the High Representative in BiH, Christian Schmidt, had issued a decision stating that any behavior that a state body deems to be unconstitutional could be the subject of their investigation and that, as he said, “they in Sarajevo are using exactly that.”

“In the Criminal Code of BiH, unconstitutional behavior is when an attempt is made to use force against the Constitution. No one here uses force, but this decision is not in accordance with the Constitution and the law…”, Dodik stated, among other things.

Let us recall that the Court of Bosnia and Herzegovina, in a first-instance decision, found Dodik guilty of disrespecting the decisions of the High Representative in BiH sentenced him to one year in prison and imposed a ban on him from holding the office of President of the RS.

The RS National Assembly then adopted laws that, among other things, prohibit the work of state judicial institutions and police agencies in the territory of this entity.

The decrees promulgating these laws were signed by the President of the Republika Srpska, and they were then published in the “Official Gazette of the Republika Srpska.”

Dodik signed decrees promulgating the Law on Non-Application of Laws and Prohibition of Activities of Extra-Constitutional Institutions of BiH, which refers to the prohibition of the activities of the Court and Prosecutor’s Office of BiH, the State Investigation and Protection Agency (SIPA) and the High Judicial and Prosecutorial Council (HJPC) of BiH.

He also signed a decree promulgating the Law on the High Judicial and Prosecutorial Council of Republika Srpska, the Law on Amendments to the Criminal Code of Republika Srpska and the Law on the Special Registry and Publicity of Non-Profit Organizations.

Authorized representatives of the cabinet of the member of the Presidency of BiH Denis Becirović, the Speaker of the House of Representatives of the Parliamentary Assembly of BiH Denis Zvizdić and the Deputy Speaker of the House of Peoples Kemal Ademović yesterday submitted an appeal to the Constitutional Court of BiH with a request to review the constitutionality of these laws and determine a provisional measure.

The Prosecutor’s Office of Bosnia and Herzegovina announced that they have been conducting investigative actions since December 2024, due to the existence of grounds for suspicion that the criminal offense of Attack on the Constitutional Order from the Criminal Code of BiH was committed.
