Following the news that in just over twenty days a public auction for the sale of the Dretelj Oil Terminal will be held at the headquarters of the bankrupt Hercegovacka Banka, with a starting price of 15.5 million BAM, we requested the OHR’s position, given that this is property that should be subject to a prohibition on disposal.
In response to our journalist’s inquiry, the Office of the High Representative responded that state property, including former military property, agricultural and forest land, as well as other public property, defined as such by relevant decisions of the Constitutional Court of Bosnia and Herzegovina, is subject to a prohibition on disposal and therefore any transfer of such property is null and void.
The OHR calls on the competent domestic institutions and authorities to investigate all relevant aspects of this case within their jurisdiction and, as necessary, to use available legal mechanisms for the protection of state property and the implementation of the law, Federalna writes.
