From 2018, 40 % Women in the Council of Ministers?

parliamentThe House of Representatives of the Parliamentary Assembly of BiH at today’s meeting will, among others, consider amendments to the Law on the Council of Ministers, on the recommendation of the Commission for achievement of gender equality, which implies that 40 % of women should be represented in this institution.

Thus, the amendments to the Law on the Council of Ministers proposed that the equal representation of both sexes will be considered as achieved if in the Council of Ministers is appointed at least 40 % of persons of both genders.

With the proposal of amendments to the Law was emphasized that the House of Representatives will refuse to confirm the appointment of the Council of Ministers, which does not reflect equal gender representation.

If this Law gets adopted, it will come into force after the general elections in 2018.

Article 20 of the Law on Gender Equality determined that government bodies at all levels of government will ensure and promote equal gender representation. Equal gender representation means that one of genders is represented at least 40 % in all bodies, otherwise it will be considered as discrimination.

In practice to date, the representation of women in the Council of Ministers was including up to 2 female ministers.

Meanwhile, the Constitutional Commission of the House of Representatives of Parliamentary Assembly of BiH established that the Proposal of Amendments to the Law on the Council of Ministers is aligned with the Constitution and the legal system in BiH.
