House of Peoples on the Draft Law on the HJPC and Amendments to the Law on the Court of BiH

The House of Peoples of the Parliamentary Assembly of Bosnia and Herzegovina (PABiH) will consider on Monday, March 23, the Draft Law on the High Judicial and Prosecutorial Council (HJPC) of BiH, as well as the Draft Law on Amendments to the Law on the Court of BiH.

These two legal acts were proposed by delegates Nikola Špirić, Dragan Čović and Kemal Ademović, and should be considered in the first reading in an abbreviated procedure, the Parliamentary Assembly of BiH announced.

The proposers stated that the Draft Law on the HJPC of BiH is based on the principles of transparency in the work of this institution, integrity of members and holders of judicial offices, as well as two-instance in their decision-making.

With these amendments, the number of members of the HJPC would be increased from the current 15 to 20, of which eight members are judges and prosecutors, one lawyer from the bar associations of Republika Srpska and the Federation of BiH, while one member will be appointed by the House of Representatives of the Parliamentary Assembly of BiH and the Council of Ministers of BiH.

The proposed amendments to the Law on the Court of BiH envisage the formation of an appellate division of this court, as a second-instance body.

In the first reading, delegates should find amendments to the Law on Salaries and Remunerations in the Institutions of BiH, which stipulate that in the event of failure to adopt the budget of the institutions of BiH, employees shall be paid the difference in salary retroactively.

The proposed agenda for the second reading also includes six laws that bear the mark of compliance with European Union legislation.

These are the draft laws on patents, industrial designs, protection of trade secrets as intellectual property rights, protection of topographies of semiconductor products, representation in the field of industrial property rights, and units of measurement in BiH.

In the second reading, delegates will see amendments to the Law on Service in the Armed Forces of BiH, which increase the age limit for retirement in military service from 40 to 45 years of age.

The second reading before the delegates should include amendments to the Law on Administrative Procedure, which provide the prerequisites for the continuation of the digital transformation of public administration in the institutions of BiH.

Also on the agenda is the approval of the ratification of a number of international agreements.
