Komsic: Schmidt must repeal Laws that would allow the Secession of the RS Entity

The High Representative in Bosnia and Herzegovina (BiH), Christian Schmidt, must immediately repeal the anti-constitutional laws on the Republika Srpska (RS) High Judicial and Prosecutorial Council of BiH (HJPC) and the RS Property Law, adopted yesterday by the National Assembly of RS (NARS), said BiH Presidency Chairman Zeljko Komsic.

Komsic said that such attacks on the constitutional order of BiH have an attempt to secede the BiH entity of RS as their final decision and that this is possible if the judiciary is disempowered.

”While there are negotiations on changes to the BiH Election Law, trying to please Dragan Covic, he does not see anything disputable in such anti-constitutional activities,” Komsic mentioned.

He added that these anti-constitutional activities cannot and must not pass without being annulled by the High Representative, as well as the reactions of the judicial institutions of BiH, primarily the Prosecutor’s Office of BiH.

”I would like to remind you that Priebe’s report on the situation in the judiciary of BiH did not say that entity HJPCs should be created, but on the contrary, the reform of the current HJPC and its strengthening was recommended. That is why we once sent a bill that resolves that, which some parliamentarians blocked at the very beginning,” Komsic pointed out.

He emphasized that it is clear to everyone what Milorad Dodik is doing.

”When he lost political control over the HJPC BiH, with the departure of his Milan Tegeltija, he now wants to create his,entity HJPC over which he would have complete control and thus protect himself and his illegal decisions. The situation is the same when it comes to the law on immovable property of RS, which is obviously preventing the implementation of the decisions of the Constitutional Court of BiH,” Komsic concluded.
