PABiH – Proposal Of The Law On The Regulator, Transmission, And Electricity Market In BiH Adopted

The House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina (PABiH) adopted at yesterday’s session the Proposal of the Law on the Regulator, Transmission and Electricity Market in BiH, which was proposed by the Council of Ministers of BiH.

Thirty-one representatives voted for the proposed law, two were against, and five abstained.

The Committee for Foreign Trade and Customs of the House of Representatives had previously supported the proposal of this law, with two adopted amendments that became an integral part of the law.

One of the amendments adopted by the Committee defines that the “delegated operator is obliged to establish a separate legal entity with its headquarters in the Brcko District of BiH, which will operate as the operator of the organized market, and establish day-ahead and intraday markets.”

In the original draft of the law submitted by the Council of Ministers of BiH, it was defined that the headquarters would be in Mostar, which was also the proposal contained in the amendment of representative Predrag Kozul, which the House of Representatives did not adopt.

The Council of Ministers of BiH had previously established the proposed law, with the EI designation, as confirmation of adequate alignment with European Union (EU) regulations in this area.

The aim of the law is the transposition of 16 EU directives and the Electricity Integration Package, with a focus on creating an organized wholesale electricity market and establishing an electricity exchange in BiH, thereby fulfilling one of the prerequisites in this area for exempting our country from the application of the Carbon Border Adjustment Mechanism (CBAM).

Positive opinions on the text of the law were given by the governments of the Federation of BiH (FBiH), Republika Srpska (RS), and the Brcko District of BiH.

After adopting the proposed law, the representatives also adopted the conclusion that the Proposal of the Law on the Regulator, Transmission and Electricity Market in BiH be submitted to the House of Peoples of the PABiH with a request for consideration under urgent legislative procedure.

The House of Representatives did not accept the negative opinion of the Constitutional-Legal Committee on the Proposal of the Law on Amendments to the Criminal Code of BiH, proposed by representative Nihad Omerovic, and returned it to the Committee for reconsideration.

The negative opinion of the Constitutional-Legal Committee on the Proposal of the Law on State Property, proposed by representatives Jasmin Emric, Semsudin Mehmedovic, Aida Barucija, and Elvis Hodzic, was also not accepted, and this legislative proposal will also be returned to the Committee for reconsideration.

The representatives adopted the conclusions of the Committee for Transport and Communications regarding the operations of BHRT.

With one of the conclusions, the House of Representatives of the PABiH instructs the Council of Ministers of BiH to allocate funds from the current reserve of the budget of the institutions of BiH to pay BHRT’s debt to Elektroprivreda BiH and “Sarajevo Gas” in the amount of 1.655.000 BAM; and with another conclusion, the House of Representatives of the PABiH requests from the Council of the Communications Regulatory Agency of BiH to act upon the conclusion from the 29th session of the House of Representatives, that is, to submit the Proposal of the decision on the amount of the RTV fee into parliamentary procedure as soon as possible.

The parliamentary initiative of Semsudin Mehmedovic was adopted, whereby the House of Representatives of the PABiH obliges the Council of Ministers of BiH to make its work fully transparent and immediately, without delay, begin timely publication on the website of the Council of Ministers of all documents related to the sessions of the Council of Ministers of BiH (except for those documents classified as “secret”).

The parliamentary initiative of Nihad Omerovic was also adopted, which obliges the Council of Ministers of BiH to, within 90 days from the day of adoption of this initiative, establish special counters for BiH citizens at passport control at airports in BiH.
