The decision of the Constitutional Court of BiH was not ignored just in the case of January 9. There were numerous other examples of non-implementation of decisions. However, nobody was held responsible for that.
In the period from 2005 to 2015, the Constitutional Court pronounced a total of 91 decisions for non-implementation of its previous decisions. As stated by the Constitutional Court of BiH, the number of non-implemented decisions in the year of 2016 was 13.
On the list of institutions that are ignoring the Constitutional Court are lower courts, assemblies of cantons and municipalities, cantonal and entity governments, the Council of Ministers of BiH, as well as certain individuals.
If we take a look at the Constitution, the decisions of the Constitutional Court of BiH are final and obligatory. Those who do not respect them should be punished by imprisonment.
Lawyer Vlado Adamovic noted that he cannot remember if anyone was ever held responsible for non-implementation of the decisions of the Constitutional Court.
“I know that there is a lot of talk about that, but I cannot remember that a decision was ever issued in this regard. I also heard some comments that it is difficult to find an official person that could be held responsible, but I would strongly disagree. If you conduct an investigation, you will find out who is obliged to implement decisions in which organ, which institution, who is held responsible for what, and who could be held responsible for non-implementation of decisions of the Constitutional Court of BiH,” stated Adamovic.
