Professor Trnka: The OHR and the BiH Constitutional Court are the Safeguards of the State

“Events in the Security Council have in some way confirmed my earlier position that we as a small country are always subject to negotiations and agreements, sometimes manipulation by the great powers,” emphasized Kasim Trnka, a professor ofconstitutional law.

“If you compare this situation to a chess game, I think the Americans lost one pawn, but good players will always save the game and win in the end. It depends on the Americans which administration is in power. I believe the Joe Biden administration has a clear vision of what to do with the Western Balkans. This territory of Southeast Europe is in some ways geostrategically very interesting and the great powers certainly have pretensions to dominate the mentioned area.“

When asked why Russia is bothered by the Office of the High Representative (OHR), Trnka told: “Everything that Dodik is doing is only because he is the executor of a policy pursued by Russia because it can strengthen its position if it introduces elements of destabilization. It is aware of the fact that Bosnia and Herzegovina (BiH) and Serbia are beside the members of the European Union (EU) and members of the NATO pact. So it is trying to infiltrate this area. If you look at the statements of the Russian embassy in BiH and Dodik’s statements, you will see that they are all the same sentences. “

According to him, the position of Christian Schmidt will be somewhat devalued since he did not receive the support of China and Russia in the Security Council, which is reflected in the position of domestic forces.

Dodik accepted the role of the executor of the Russian-Belgrade policy

“He accepted the role of being the executor of Russian-Belgrade policy. He is very successful in that role. Putin is the head of a world power that has a very significant role in international relations, and he has repeatedly hosted Milorad Dodik in the Kremlin as a local ‘tough guy’. But he does not host him by accident, but to give him instructions on how to engage in the implementation of his policy in this area. Aleksandar Vucicplays a double game. He, wanting to preserve Serbia’s role in international relations, will never make statements against the sovereignty of BiH and which call into question the Dayton Peace Agreement, etc. But just as he instructs his minister Vulin to say what he would like to say, he does the same with Dodik, so that he implements what Vucic really thinks.“

When it comes to trying to transfer competencies from the state to the entities, Trnka explained that one should be very careful and cautious.

If we all remain passive then we don’t even deserve better

He explained that the HR with his powers and the Constitutional Court with three foreign courts are the last safeguards of the constitutional system that prevent its collapse.

Trnka thinks that the Federation of BiH (FBiH) is burdened with its problems that are sufficient to not give an adequate response to what is happening in the Republika Srpska (RS) and a good part of the FBiH.

“Now is the right time to mobilize the wider democratic public and to say that there are those in BiH who want a different BiH, who are ready to fight for such a BiH by democratic means.”

“If we all stay passive, then we don’t deserve better. We can’t always say that Biden should save us,” Trnka concluded.
