Prohibitive Measures ordered against Suspects in the Case of Ibrahim Puric et al.

Ruling on the Motion filed by the BiH Prosecutor’s Office to order custody of the suspects Ibrahim Puric, Ibrahim Tarahi, Nijaz Sivro, Rusit Nurkovic, Sadik Omanovic, Sacir Omanovic, Kasim Kavazovic, Almir Sarajlic, on 9 November 2018 the Court of Bosnia and Herzegovina issued a Decision denying the Prosecutor’s Motion to order the suspects into custody, while imposing the following prohibitive measures of ban on meeting with certain individuals under Article 126.a), Paragraph 1(c) of the Criminal Procedure Code of Bosnia and Herzegovina (CPC BiH).

At the same time, pursuant to Article 126(1) of the CPC BiH, the suspects Sadik Omanovic, Sacir Omanovic, Kasim Kavazovic and Almir Sarajlic received the ban on leaving their place of residence and the measure of periodical visits at the home addresses by police officers under Article 126a), Subparagraph d), of the CPC BiH.

The imposed measures may last for as long as necessary, while their justifiability will be checked on a bi-monthly basis. If the suspects violate any of the obligations imposed by the prohibitive measures, they may be remanded into custody.

Ibrahim Puric et al. are suspected of the criminal offense of War Crimes against Prisoners of War under Article 175 of the Criminal Code of Bosnia and Herzegovina (CC BIH) and the criminal offense of War Crimes against Civilians under Article 173 of the CC BiH, all as read with Articles 29 and 180, Paragraphs 1 and 2 of the CC BiH.
