Revision of the Lawsuit against Serbia, New Evidence on the side of BiH?

Lawsuit_BiH_SrbiaThe deadline for initiating the review of the lawsuit of BiH against Serbia for genocide before the International Court of Justice will expire on the 26th of February, and BiH might, through its agent in the dispute Sakib Softic, start this process within the stipulated time frame.

As a reminder, the International Court of Justice on the 26th of February 2007 made a decision in the case of BiH against Serbia and Montenegro for violation of the Convention on the Prevention and Punishment of the Crime of Genocide, which was launched in 1993, and confirmed that Serbia has not committed genocide, through its organs. In the decision was stated that there was no conspiracy to commit genocide in Serbia, nor Serbia encouraged genocide. However, it was found that Serbia violated the Convention on Genocide by a nonperforming obligation to prevent genocide.

In the meantime, new facts that give legitimacy to the revision of the whole process appeared, such as the recognition of General of Yugoslav National Army (JNA) Momcilo Perisic that he sent foreign troops in BiH, and the content of published transcripts of sessions of the Supreme Defense Council of Serbia, which revealed that the Serbian regime led by Slobodan Milosevic was directly involved in the war in BiH.

The existence of new facts and evidence was confirmed by the former ICTY prosecutor Geoffrey Nice.

“BiH lost the lawsuit due to lack of evidence, but there is a significant number of previously unused evidence since 2007,” said Nice during a recent visit to BiH.

Judgment for Radovan Karadzic and proceedings against Ratko Mladic are going in favor of justification of the revision.

“It is more important to take responsibility for future generations of BiH rather than focus on the current political problems. BiH must fight for this, no one else cares. If you try, maybe you will succeed,” added Nice.

Bakir Izetbegovic, the Bosniak member of the Presidency of BiH, said several times in the past that he supports the initiation of this proceeding if there is new evidence. Among others, he said this to Aleksandar Vucic, the Prime Minister of Serbia, when they met in Mostar last year, and he repeated the same in interviews that he gave in recent days.
