HR Schmidt is warned: Cavara himself interviews Judges outside the HJPC

Vice Presidents of Federation of Bosnia and Herzegovina Melika Mahmutbegovic and Milan Dunovic addressed the High Representative Christian Schmidt today.

Mahmutbegovic and Dunovic informed Schmidt that there is verified information and knowledge that FBiH President Marinko Cavara is inviting candidates for judges of the FBiH Constitutional Court to an interview on his own initiative and beyond all procedures.

”In this way, Cavara directly violates the FBiH Constitution, and takes away the competence of the HJPC of BiH, which has already carried out the competition procedure prescribed by law and which is the only one competent for such a thing, Mahmutbegovic and Dunovic state in their letter to Schmidt and add:

“President Cavara does not have the authority and legal basis, but neither does he have the competence to review and interview candidates for judges of the Constitutional Court of the Federation of BiH for whom the High Judicial and Prosecutorial Council of BiH has already conducted the competition procedure and submitted the opinion of the Constitutional Court of the Federation of BiH on the candidates.

Let us remind you that today in a letter to Schmidt, Cavara said that, after almost three years, he decided to give his consent for the appointment of judges to the Constitutional Court of FBiH.
