The Constitutional Court of Bosnia and Herzegovina has overturned the verdict against Fikret Hodžić and his company “Srebrena Malina” in a case related to the procurement of respirators. The court found that the appellants did not know what they were being charged with, which violated their right to a fair trial.
The case will be returned to the Court of Bosnia and Herzegovina, where a decision will be made regarding this case. This practically means that Hodžić is released.
The appeals of Novalić and Solak were partially accepted. It was also found that their rights to a fair trial were violated, in relation to the statements of public officials Nermin Nikšić, Elmedin Konaković and Fahrudin Radončić.
Judge Mirsad Ćeman dissented and requested an acquittal for both Novalić and Solak. However, they remain in prison.
