The Constitutional Court of BiH to decide on Appeal of Two Presidency Members

The Constitutional Court of Bosnia and Herzegovina, considered the requests of Željko Komšić, a member of the Presidency of Bosnia and Herzegovina, and Šefik Džaferović, at the time of submitting the request the Chairman of the Presidency of Bosnia and Herzegovina, for the review of the constitutionality of the Amendment to the Constitution of the Federation of Bosnia and Herzegovina and the Law on Amendments to the Election Law of BiH. As it was announced, the decision, in that case, has not been made and it will be decided at one of the next plenary sessions.

The request seeks to establish the inconsistency of the provisions of the disputed Amendments and Laws with the Constitution of Bosnia and Herzegovina, first of all, in the part that refers to the democratic principle and the consequent principle of the rule of law, i.e. the principle of legal certainty.

The Constitutional Court of Bosnia and Herzegovina, at its session, which was held on January 19 and 20, issued a decision establishing that the Commission for Concessions of Bosnia and Herzegovina in its capacity as the Joint Commission for Granting Concessions (in the sense of Article 4, Paragraph 3 and Article 6 paragraph 2 of the BiH Law on Concessions) did not implement the Partial Decision of the Constitutional Court of BiH from July 16, 2021. The Constitutional Court will deliver today’s decision to the BiH Prosecutor’s Office.
