The Constitutional Court of BiH Upholds Verdict Against Milorad Dodik, Rejects His Appeal

The Constitutional Court of Bosnia and Herzegovina rejected Milorad Dodik’s appeal and upheld the final judgment of the Court of BiH, which convicted Dodik of disobeying the decisions of the High Representative in BiH.

On 4 November 2025, the Constitutional Court of Bosnia and Herzegovina held its 10th extraordinary plenary session, at which it issued a decision on the admissibility and merits of Milorad Dodik’s appeals. The Constitutional Court rejected as inadmissible Milorad Dodik’s appeal filed against the Decision of the Court of Bosnia and Herzegovina No. of 18 August 2025 and the Decision of the Central Election Commission of Bosnia and Herzegovina (CEC) of 6 August 2025.

By the decision on admissibility and merits in case number AP-3722/25 (Milorad Dodik), the Constitutional Court dismissed as unfounded the appeal of Milorad Dodik filed against the Judgment of the Court of Bosnia and Herzegovina number S1 2 K 046070 25 Kž 2 of 12 June 2025 in relation to Article II/3.e) of the Constitution of Bosnia and Herzegovina and Article 6. paragraph 1 of the European Convention for the Protection of Human Rights and Fundamental Freedoms (European Convention), Article 7 of the European Convention and Article 18 of the European Convention in conjunction with Article 6 of the European Convention.

The Constitutional Court dismissed as inadmissible the appeals of Milorad Dodik filed in relation to Article II/3.e) of the Constitution of Bosnia and Herzegovina and Article 6. paragraph 2 of the European Convention in relation to the statements of public officials made during the trial of the appellant because they were manifestly (prima facie) unfounded.

The Constitutional Court has dismissed as inadmissible the appeal of Milorad Dodik filed against the Decision of the Court of Bosnia and Herzegovina No. S1 3 Iž 052766 25 Iž of 18 August 2025 and the Decision of the Central Election Commission of Bosnia and Herzegovina (CIK) No. 06-1-07-939/25 of 6 August 2025 in relation to Article II/3.e) of the Constitution of Bosnia and Herzegovina and Article 6, paragraph 1 of the European Convention, and Article 3 of Protocol No. 1 to the European Convention on the grounds that it is ratione materiae incompatible with the Constitution of Bosnia and Herzegovina.

On 1 August, the Appellate Panel of the Court of Bosnia and Herzegovina upheld the first-instance verdict of Milorad Dodik, after that verdict sentenced him to one year in prison and a six-year ban on holding political office for disobeying the decisions of the High Representative in BiH, Christian Schmidt.
