BiH Court sentences Person for not coming to Work, but receiving a Salary

Due to not coming to work, Dušan Jovanović, acting former assistant minister in the Ministry of Scientific and Technological Development, Higher Education and Information Society in the Government of Republika Srpska, was accused of damaging the budget by around 7,000 marks.

The indictment was brought against him by the entity prosecutor’s office, which accuses him of abuse of official position or authority, and it was confirmed by the judge for the preliminary hearing of the District Court in Banja Luka.

According to the indictment, from November 17, 2022 to January 31, 2023, he acted contrary to the provisions of Article 21, Paragraph 1 of the Law on Civil Servants, because he did not come to work and did not perform the duties and tasks of the workplace to which he was appointed.

“He acted contrary to the provisions of Article 78, paragraph 2 of the Law on the Administration of the Republic, because he did not manage the area of work of the ministry for which the department was formed for which he was appointed as an assistant minister, even though he received net salaries in the total amount of 7,078 for the specified period. The accused was aware of his act, the execution of which he wanted, and by not performing his official duty, he obtained a benefit for himself,” it is stated in the indictment, Nezavisne novine reported.

It is also stated that during the mentioned period, Jovanović had the capacity of an official, that is, he held the position of acting Assistant Minister for Scientific and Technological Development in the Ministry of Scientific and Technological Development, Higher Education and Information Society of the RS.

Appointed to that position by the Decision of the Government of the RS dated November 3, 2022.
