Will the Technical Inspections of Vehicles be accepted in both Entities?

The Ministry of Communications and Transport of BiH informed the cantonal Ministry of Interior in the Federation of BiH that they must apply the regulations harmonized at the state level when it comes to the recognition of technical inspections in both BiH entities.

This means that technical inspections from Republika Srpska will be recognized in the Federation of BiH when registering vehicles, and vice versa, despite the decision of the Government of the Federation of BiH from March 10 this year, which no longer recognizes technical inspections of vehicles performed outside FBiH, Klix.ba writes.

Namely, the decision of the Government of the Federation of Bosnia and Herzegovina, which entered into force on March 10, 2022 is not in accordance with the applicable legislation in BiH, as it is in conflict with the provision of Article 73, paragraph 1 of the Rulebook on vehicle registration, as a state regulation.

The provision of Article 73, paragraph 1, of the Rulebook on vehicle registration stipulates that the competent authority in the process of vehicle registration accepts proof of technical correctness of the vehicle from any station of technical inspection of vehicles imported into the information system.

In its responses to the cantonal Ministries of Interior, the BiH Ministry of Communications and Transport pointed out that any reference to legislation in force in the Federation of BiH, which is not harmonized with the law at the level of Bosnia and Herzegovina, is contrary to applicable law.

The competent body in the registration procedure in accordance with the Law is the body in charge of internal affairs and it is stated that decisions that violate the unified registration system are repealed without delay.

In previous letters, the Ministry informed that the provisions of the Ordinance on technical inspections of vehicles regarding the implementation of video surveillance entered into force on 31.12.2020 and that the conditions for full application of Article 73 of the Rulebook on Vehicle Registration are met.

Accordingly, the Ministry of the Interior of the Sarajevo Canton acts in accordance with the Provision of Article 73, paragraph 1, of the Rulebook on Vehicle Registration and accepts the certificate of technical inspections made in the RS.
