BiH won the Case against Republika Srpska

RS The Government of Republika Srpska (RS) is obliged to pay a total of 182,338.67 BAM for the sake of financing the State Aid Council of BiH, as confirmed by the Appellate Chamber of the Court of BiH.

The RS lost the lawsuit that was brought against it by the Public Attorney’s Office of BiH and it is obliged to pay 182,338.67 BAM for financing the State Aid Council of BiH, as confirmed from the Council of Ministers of BiH, at whose lawsuit against the RS the Court of BiH judged that RS is obliged to pay 80,338.67 BAM on the name of the financing of the State Aid Council for 2013, and a total of 102,000 BAM for 2014.

This verdict, as stated by the Ministry of Foreign Trade and Economic Relations of BiH, was confirmed by the Appellate Chamber of the Court of BiH.

On the question of a member of the Collegium of the House of Representatives of the Parliamentary Assembly of BiH, Sefik Dzaferovic, on what has been done on the implementation of the Law on State Aid of BiH and if there are problems in its implementation, the Minister of Foreign Trade and Economic Relations of BiH, Mirko Sarovic, stated that it was determined that the Law on the State Aid is not harmonized with European legislation.

“The main problem in the implementation of the way of financing the Council, given the fact that the Council with the Secretariat is financed by one-third from the budget of BiH, the budget of FBiH and the budget of RS, in accordance with Article 9 of the Law. The RS paid only 40,000 BAM in the budget of the Council for 2013 and 40, 000 BAM for 2014, and it owes the amount of 80,338.67 BAM for 2013, and the amount of 102,000 BAM for 2014. Public Attorney’s Office of BiH filed a lawsuit to the Court of BiH for payment of debt, and the Court of BiH issued a first instance verdict on the 12th of February 2016, and ordered the RS to pay two-year debt in the amount of 182,338.67 BAM, together with default interest and costs of civil proceedings. In late March, the Appellate Chamber of the Court, while acting on the appeal of the RS, denied the allegations and confirmed the first instance verdict, and the verdict from the 30th of April received the clause of finality on the Court. The RS made an extraordinary legal remedy of revision of the final and enforceable verdict, but revision will not postpone the execution of the judgment, and the Public Attorney’s Office of BiH made the proposal for enforcement of the final and enforceable verdict on the 8th of June, said Minister Sarovic.
