Bosnian Court issued Indictment against One Person for Organizing a Terrorist Group

The Court of Bosnia and Herzegovina confirmed, on 15 May 2020, an indictment charging the accused Emir Ališić with the commission of the criminal offense of Organizing a Terrorist Group under Article 202d (2), in connection with Paragraph 1, all in connection with the criminal offense of Terrorism under Article 201 of the Criminal Code of Bosnia and Herzegovina (CC BiH).

The indictment alleges that, on 13 December 2013, the accused Emir Ališić left the territory of Bosnia and Herzegovina with the aim to join a foreign military or paramilitary formation active outside Bosnia and Herzegovina, and that having arrived in Syria, he became a member of several paramilitary formations within ISIL, in the territory of the towns of Raqqa and Haritan. The indictment alleges that the accused Emir Ališić was a member of the said units during the period between December 2013 and the beginning of 2019, when he surrendered to the Kurdish forces after they had captured him in the Syrian territory, whereupon he was deported from Syria to Bosna and Herzegovina.

Also, the Court of Bosnia and Herzegovina confirmed, on 14 May 2020, an indictment charging the accused Milarem Berbić with the commission of the criminal offense of Illegal Establishment and Joining Foreign Paramilitary or Parapolice Organizations under Article 162b (2) of the Criminal Code of Bosnia and Herzegovina (CC BiH).

The indictment alleges that, on 29 August 2014, the accused Milarem Berbić left the territory of Bosnia and Herzegovina with the aim to join a military or paramilitary formation active outside Bosnia and Herzegovina. The indictment further alleges that, having arrived in Syria, the accused Milarem Berbić became a member of a paramilitary formation under ISIL’s control, where he stayed until the beginning of 2019, when he was captured by the Kurdish forces and subsequently deported from Syria to Bosnia and Herzegovina.
