Ruling on the Motion filed by the BiH Prosecutor’s Office to order custody of the suspects Pero Radic and Petko Tomic, on 14 December 2018 the Court of Bosnia and Herzegovina issued a decision dismissing the Prosecutor’s Motion, while imposing the prohibitive measures of travel ban under Article 126(2) of the Criminal Procedure Code of Bosnia and Herzegovina (CPC BiH), ban on meeting with certain individuals under Article 126.a(1)c) of the CPC and obligation of periodical reporting to the state authority under Article 126.a(1)d) of the CPC BiH.

Partly granted is Prosecutor’s Motion filed on 14 December 2018 to impose prohibitive measures, so the following prohibitive measure is imposed on the suspects Bozo Vidovic and Branko Studeni, hence ban on meeting with certain individuals under Article 126.a(1)c) of the CPC BiH.

The imposed prohibitive measures may last until necessary, while the control of their justifiability shall be carried out on a bi-monthly basis. If the suspects violate the obligations specified under the prohibitive measures, they may be ordered into custody.

Vlado Ristanic et al. are suspected of the criminal offense of Crimes against Humanity under Article 172(1)h), as read with Subparagraphs a), d) and i) of the Criminal Code of BiH (CC BiH), in conjunction with Article 180(1) of the CC BiH, all as read with Article 29 of the Code.
