Debevec dismissed as President of the Court of BiH

The first-instance disciplinary commission of the High Judicial and Prosecutorial Council of Bosnia and Herzegovina (HJSC BiH), in the disciplinary proceedings against the President of the Court of Bosnia and Herzegovina, Ranko Debevac, issued a Decision that determined the disciplinary responsibility of the defendant and imposed a disciplinary measure of dismissal from the position of both the President and the judge of the Court of Bosnia and Herzegovina.

Namely, the defendant was declared responsible for the fact that, in a period of at least one year and nine months, although as the head of the Court of Bosnia and Herzegovina he was aware of the obligation to automatically allocate cases to the work of judges and the obligation to ensure, supervise and control the regularity of the automatic allocation of cases prescribed by the Council’s bylaw, in 16 cases he failed to act in accordance with the relevant provisions of the Ordinance on the system for automatic case management in courts. In doing so, he deliberately violated his official duty and called into question the public’s trust in the impartiality and credibility of the judiciary and committed a disciplinary violation of the Law on the HJPC of BiH: “any other behavior that constitutes a serious breach of official duty or calls into question the public’s trust in the impartiality and credibility of the judiciary”.

In this regard, in accordance with the Law on the HJPC of Bosnia and Herzegovina and in accordance with the Guidelines for determining disciplinary measures in disciplinary proceedings, the aforementioned disciplinary measure was imposed on the defendant.

The decision of the First Instance Disciplinary Commission can be appealed to the Second Instance Disciplinary Commission of the HJPC of Bosnia and Herzegovina, the HJPC announced.
