Djonlagic: Negotiations are meaningless while the State is in Danger

Dzenan Djonlagic, the Democratic Front (DF) representative in the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina (PABiH), was interviewed yesterday. He said the transfer of High Judicial and Prosecutorial Council of BiH (HJPC) competencies from the state to the entity is a new attack on the state.

”It is unacceptable. After we had a political adventure with the Medicines Agency, Dodik’s path of destroying the legal order of BiH continues and now he has moved to the state judiciary with the goal of disempowering the HJPC, specifically the BiH judicial system where we have the BiH Prosecutor’s Office and the BiH Court. There was another attempt sometime in 2009 by the entity government and the entity assembly. Then the Office of the High Representative (OHR) reacted. Valentin Inzko repealed that decision of the entity assembly. This time it is absolutely necessary for the High Representative in BiH, Christian Schmidt to act in the same way. If all this comes into force, and the intention is that it will come into force, an immediate intervention measure is necessary to put it out of force. Otherwise, we enter into a legal uncertainty,” Djonlagic explained.

The matter is much more serious than political spin and manipulation

Djonlagic believes that the matter is much more serious than political spin and manipulation: ”What Milorad Dodik and the Alliance of Independent Social Democrats (SNSD) and the political group around him are doing, I would not call it daily political activities and I would not classify it in any pre-election activity or preparation for elections, etc. I think that this is an agenda that is very much connected with the story about the Memorandum of the Serbian Academy of Sciences and Arts (SANU Memorandum), and of course that the current political leadership in Belgrade has its fingers in it here. Milorad Dodik practically sees his political mentorship in Belgrade and Moscow. He obviously chose the side, this time to go against the United States (U.S.) administration and the European Union (EU), and to follow the policy of Moscow and Belgrade.”

The reaction of domestic institutions is more important than that of the international community

”On the issues of overthrowing the constitutional order and attempts to collapse institutions at the level of BiH. I do not see room for compromise here. I think that the reaction of domestic institutions is more important here than the international community. These issues are actually being tested. Unfortunately, the institutions are not reacting. But they will be responsible for what happens in BiH. There is no doubt that the Prosecutor’s Office of BiH is responsible for all negative events within the political system of BiH from today or practically from the moment it started with the Medicines Agency bears responsibility for all negative developments within the BiH political system, ”

He believes that the announced EU sanctions will not happen

”That is the weakness of the EU. Obviously, things are not right within the EU institutions, in the current convocation of the European Commission, the European Council, and other important institutions at the EU level. Since there is no agreement at the level of BiH institutions, it is very possible that we will expect a reaction from some member states. This segment of sanctions will also be very important. This type of economic and financial sanctions can yield certain results. It is most evident that it will hit companies operating in the part of the market that is focused on Republika Srpska (RS). In that sense, of course, the negative economic consequences will be there, but given that we are talking about a single economic space in BiH, it is evident that the BiH economy will partly feel these negative implications. Especially if there is a suspension or slowdown in the delivery of funds coming from, say, the European Bank for Reconstruction and Development (EBRD), etc. ”

U.S. sanctions have partly paid off

Regarding the U.S. sanctions, Djonlagic said that they partially achieved the result and that it will take some time to see if they really had the full effect. He stated that Milorad Dodik did not deceive Aleksandar Vucic, who asked him to return to BiH institutions.

Covic’s statement is monstrous

Regarding Covic’s statement, keep the RS, he mentioned: ”Completely meaningless statement. Monstrous, completely inadmissible, but in the political context, the political goals, and political activities of the Croatian Democratic Union (HDZ) and Dragan Covic, it is not surprising to me. This act of Covic where he is leading the story about the changes to the Election Law actually helps Milorad Dodik’s policy. And reverse. The goal is to make the institutions of BiH meaningless and to show the non-functionality and unsustainability of the actual current organization of BiH and the cementing of the ethnic model or ethnic concept of the political organization of BiH. ”

Elections can and must be held

Also, he emphasized that a solution can be reached only if we want to implement all the judgments of the European Court of Human Rights: ”It is pointless to sit at the table and negotiate. The DF is lobbying for the civic order of BiH. Who should we participate in the negotiations with? You cannot sit at the table and discuss changes to the Election Law to satisfy Dragan Covic’s wishes while Milorad Dodik breaks up the state. It is our priority to stop the anti-constitutional activities of the National Assembly of RS (NARS). ”

He stated that it is completely untrue that without changes to the Election Law, there are no conditions for holding elections because BiH has a valid Election Law: ”Elections can and must be held, there is no doubt about that.”
