Dodik: We will soon resolve the Issue of Foreign Judges in the Constitutional Court of BiH

The implementation of the last agreement with the parties from the Federation of BiH does not depend only on us, but we know exactly what we agreed on and what we are looking for. Along with the set of European laws that will be on the agenda of the BiH Parliament at the end of August, a law should be prepared that will resolve the issue of foreign judges in the Constitutional Court of BiH. After that, we will move on, President of Republika Srpska Milorad Dodik said this for “Glas”.

“This is only the first phase. The working group has until the end of August or in September to present a solution that will solve the issue of foreign judges. It is no longer a test for us, but for others. Realistically speaking, it was not possible to do it before,” said Dodik.

He emphasizes that he is neither an optimist nor a pessimist.

“Everything that is done at the level of Bosnia and Herzegovina is a very difficult process. You have three sides with as much electricity as you want. When someone from Banja Luka looks at it idealistically, of course everything that happens seems chaotic. But we don’t want to cause a problem neither to the second nor to a third party, but the goal is to return the authority to that Constitutional Court. A series of things they did are unconstitutional, we’ve been talking about it for years. Some think that there are quick solutions in politics, but even in less complex circumstances, things don’t go so smoothly. It is important that our laws on non-application of Constitutional Court decisions and non-publication of OHR decisions in the Official Gazette of Republika Srpska remain in force,” says Dodik.

Regarding whether there will be further discussions on the law on the Constitutional Court itself and whether the Republika Srpska remains with the proposal that there should be three judges from each nation in that institution and that there should be at least one representative of each nation in the decision-making process, Dodik points out that “they are looking for three, and that in the Federation of Bosnia and Herzegovina they can negotiate.”

“That is our proposal. We are looking for three, and they can come to an agreement in the Federation of Bosnia and Herzegovina. That parity is impossible to change, as is the consensus in decision-making. You have shooters in the Federation of Bosnia and Herzegovina who say yes, regardless of what the list is they call was illegal and according to which there are 50 percent Bosniaks in Bosnia and Herzegovina, they should also have 50 percent representatives everywhere, including in the Constitutional Court. But the constitution of BiH does not allow that. It is not the number that matters, but parity.”

Regarding the announced adoption of a set of European laws, he said that he does not believe in the European Union and its intentions.

“The EU is not what it used to be. Believing in something is a matter of personal reflection and realization. Europe, and we can read about it lately, is in a regression which means that the standard of the population is falling, in Germany they expect a lot of problems, deindustrialization is on the scene the EU itself, because laws were adopted that prohibit state intervention in the real sector, and the USA passed a law that stimulates this, so that large industries move to the USA. Instead of gas from Russia, they got more expensive gas from America. Processes are happening, just look at France, and the EU thinks that we will become passive by entering there. I don’t believe in the Europe that I can see, and the one that caused my trust no longer exists.”
