House of Representatives of the BiH PA on Amendments to the Criminal Code of BiH

The House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina is scheduled to consider the Draft Law on Amendments to the Criminal Code of Bosnia and Herzegovina, proposed by MP Denis Zvizdić, at its session scheduled for today.

The Constitutional and Legal Committee of the House of Representatives supported the draft law in the second phase of the committee.

Zvizdić proposes that the current provision, according to which “a prison sentence of up to one year shall be replaced, at the request of the convicted person, with a fine to be paid in a lump sum within 30 days”, be replaced with a provision according to which a prison sentence of up to one year may be replaced, at the request of the convicted person, with a fine.

He previously explained that the proposed amendment to the Criminal Code of BiH prevents the redemption of a prison sentence with a fine, for example in cases such as: inciting national, racial and religious hatred, discord and intolerance, international trafficking in human beings, smuggling of persons, as well as other criminal acts against humanity and values ​​protected by international law.

This means, he stated, that the Court will be able to determine, taking into account the special circumstances of each individual case, the mandatory serving of a prison sentence.

In the second round of voting, MPs should decide whether the Draft Law on Amendments to the Law on the Basics of Road Traffic Safety in BiH, whose proponent is MP Mija Karamehić-Abazović, should be considered under urgent procedure, after the Collegium of the House did not reach an agreement on this.

For the same reason, in the second round of voting, they should also decide whether the Draft Law on Amendments to the Election Law of BiH, proposed by Nenad Grković, should be considered under urgent procedure.

Members of the Collegium did not reach an agreement on whether the Draft Law on Amendments to the Law on Salaries and Remunerations in the Institutions of BiH, proposed by MPs from the SDA Club, should be considered under urgent procedure, and MPs will also decide on this in the second round of voting.

The agenda should include, among other things, reports of the Audit Office of BiH Institutions on the financial audit of BiH institutions for 2023, as well as the Annual Audit Report on the main findings and recommendations for 2023.
