Indictment confirmed for Eight Persons charged of War Crimes against Civilians

On 1 February 2019 the Court of Bosnia and Herzegovina confirmed the indictment charging the accused Zijad Srabović, Refik Morankić, Ahmet Bajrić, Senaid Ćosić, Abid Arapčić, Pašaga Čajić, Mirsad Žilić and Samir Džambić with the criminal offense of War Crimes against Civilians under Article 142(1) of the Criminal Code of the Socialist Federative Republic of Yugoslavia (CC SFRY).

The indictment alleges that during the war in Bosnia and Herzegovina and the armed conflict between the Army of Republika Srpska and the Territorial Defense of BiH, subsequently Army of BiH, in the territory of the Lukavac municipality, in the period between June to mid-October 1992, the accused acted in violation of international humanitarian law, specifically Article 3(1), Subparagraphs a) and c), of the Geneva Convention Relative to the Protection of Civilian Persons in Time of War of 12 August 1949, and Article 4 of Additional Protocol II which prohibits discrimination on any grounds, violence against life, health or mental welfare of people, especially all kinds of murder. Zijad Srabović stands accused that in his capacity as assistant commander for security at the TO Lukavac Headquarters he committed and failed to prevent inhumane treatment, torture, murder and unlawful detention of civilians, and as a responsible person failed to take the necessary and reasonable measures to prevent such treatment.

Refik Morankić is accused that as a member of the TO Lukavac Headquarters and commander of the military unit also known as “Fiko’s unit (Fikina jedinica) and HVO Modrac,” and prison commander at the “Slaughterhouse (Klaonica)” he ordered unlawful detention of civilians, committed and enabled torture and inhumane treatment, and as a superior and responsible person he failed to take the necessary and reasonable measures to prevent torture, murder, inhumane treatment of detained civilians. Ahmet Bajrić is accused that as a military policeman at TO Lukavac Headquarters, and then also a member of the military unit also known as “Fikina jedinica and HVO Modrac” he participated in inhumane treatment, torture and killing of civilians.

The accused Senaid Ćosić and Abid Arapčić are charged that as members of the military unit also known as “Fikina jedinica and HVO Modrac” they committed and enabled torture, murder, inhumane treatment of detained civilians. The accused Pašaga Čajić, Samir Džambić and Mirsad Žilić are charged that as a military policemen at the TO Lukavac Headquarters they participated in the torture of civilians.
