National Assembly: Republika Srpska will not publish the Decisions of the HR

Deputies of the National Assembly of the Republika Srpska (NSRS) adopted the Draft Law on Amendments to the Law on the Publication of Laws and Other Regulations of the Republika Srpska, under an urgent procedure.

The adoption made it impossible to publish the decisions of the OHR and High Representative Christian Schmidt in the Official Gazette of Republika Srpska.

Out of a total of 61 MPs present, 54 voted for the adoption of the mentioned legal act, and no one was against or abstained.

There were no proposed amendments to the changes in the law.

In this document, it is emphasized that Schmidt cannot be considered a high representative in Bosnia and Herzegovina, since he was not appointed in accordance with Article 1 paragraph 2 of Annex 10, and that because of this the RS will no longer publish his regulations and other acts in the Official Gazette.

Among other things, in the proposed amendment to the aforementioned law, it is stipulated that the provisions that stipulate the obligation to publish in the Official Gazette of Republika Srpska regulations and other acts adopted by the high representative in Bosnia and Herzegovina within the scope of his competence are to be deleted from it.

“Article 2 stipulates that the law enters into force on the eighth day from the day of its publication in the Official Gazette of the Republika Srpska,” the explanation of the said act states.

The session also adopted conclusions calling on the representatives of the Republika Srpska to leave the institutions of Bosnia and Herzegovina if the law on the Constitutional Court is not adopted.

One of the conclusions is that the Government of the Republika Srpska and the Ministry of Justice of the RS are tasked with preparing a law on the non-application of the decisions of the Constitutional Court of BiH on the territory of the Republika Srpska and to let it go through the parliamentary procedure if, as stated, the “unconstitutional action of the Constitutional Court of BiH” continues.
