SDA Party: A necessary but insufficient Measure by High Representative

The Democratic Action Party (SDA) believes that the decisions of High Representative Christian Schmidt to invalidate the laws by which the National Assembly of the RS declared invalid the decisions of the Constitutional Court of Bosnia and Herzegovina on the territory of that entity and thereby attacked the constitutional order of Bosnia and Herzegovina and abolished the obligation to publish decisions of the High Representative in the Official Gazette of the RS, a necessary but not sufficient measure.

According to the statement of the SDA, the practice so far has shown that without rigorous sanctioning and dismissal of responsible individuals, the attacks on the constitutional order of Bosnia and Herzegovina will not stop.

On the contrary, the SDA explained, the mild reactions of the OHR and the rest of the international community only further encouraged “Dodik to continue with secessionist politics and arrogant insults to the state of BiH, Bosniaks, OHR, the Prosecutor’s Office, Western ambassadors…”

“We also consider the decision of the High Representative to be positive, which amended the Criminal Code of BiH and made it easier for the Prosecutor’s Office of BiH to prosecute persons who attack the constitutional order of BiH,” emphasized the SDA.

However, they add, the Prosecutor’s Office of Bosnia and Herzegovina had grounds to prosecute these criminal acts, as well as the criminal offense of denial of genocide, but they avoided doing their job.

The SDA believes that if such practice continues, prosecutors who avoid their legal obligations must be removed from office.
