“The Issue of State Property can only be resolved by Passing a law in PSBiH”

Member of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina Safet Kešo (SDA) stated that the position of the SDA is known, that the issue of state property can only be resolved at the address of the Parliamentary Assembly of Bosnia and Herzegovina with a law that would have to be adopted in both chambers.

The SDA previously stated that, according to the Constitution of Bosnia and Herzegovina, the owner of state property is the state and as such must be registered in land registers, cadastres and other public records.

The issue of management, use and disposal of state property can only be regulated by a law to be passed by the Parliamentary Assembly of Bosnia and Herzegovina. The aforementioned law must be in accordance with the Constitution of BiH and the decisions of the Constitutional Court of BiH on the subject of state property – the position of the SDA.

MP Safet Kesho says that the Constitutional Court previously made some decisions regarding state property and clearly ruled that it is the property of the state.

“It is also known that the law on the prohibition of disposal since 2005 served to a good extent to protect the interests of the state in terms of the protection of state property. It is a fortunate circumstance that the law provides for the possibility of exemption from the prohibition of disposal of property, that it should be declared that some project is of public interest for the state or some level of government and that exemption can then be made,” said Kešo for Fena.

He added that a good example is the sale of land for the construction of the embassy of the United States of America in Sarajevo.

Our position, he stated, has remained unchanged for years, “that the issue of state property can only be resolved at the address of the BiH Parliamentary Assembly by a law that would have to be adopted there by both chambers”.

Kešo reiterated the position of the SDA that until the said law is passed, and in order not to block economic development, it is necessary to activate a commission at the state level that would make individual exemptions from the temporary ban on the disposal of state property.
