The Process of adopting Children in BiH

Some children have many wishes – from a new scooter, sneakers, gaming consoles, to travel, and there are those who only want a sincere hug, in a warm and dry home, which would make up for all the time, attention and care that their parents did not manage to provide them.

The complicated procedure and the lack of staff in the Social Work Centers meant that in 2021, only 30 couples in the Federation of Bosnia and Herzegovina (FBiH) decided to take this step. There are still no official data for 2022.

In order to initiate the adoption procedure, potential adopters, that is, interested persons, submit a request for adoption to the Social Work Centers in their local communities.

After that, the guardianship authority, on the basis of the evidence obtained, determines whether the conditions for establishing the adoption of a child prescribed by the Family Law have been met.

A child can be partially adopted up to the age of 18. Spouses can adopt incompletely jointly, one spouse with the consent of the other and the stepmother or stepfather of the child being adopted.

Also, unmarried persons and common-law partners who have lived in a common-law union for at least 5 years can adopt incompletely if there are particularly justified reasons for this. By establishing an incomplete adoption, the same rights and duties between adoptive parents and adopted children arise as between parents and children.

This topic was commented by Lana Lekic, a proud mother of four children, who decided to adopt the three of them after the birth of her son together with her husband.

What are the legal and what are the “human” conditions that need to be fulfilled in order to realize this right?

The conditions are simple – love and your desire, which social centers recognize through the application you send them and through the conversations you have with them. All married couples up to the age of 45 can exercise the right to adoption, Klix.ba reports.
