A two-day Plenary Session of the Constitutional Court began

A two-day plenary session of the Constitutional Court of Bosnia and Herzegovina began in Sarajevo. Before the judges, among other things, is Borjana Krišto’s request for an evaluation of the constitutionality of the Law on the Court of Bosnia and Herzegovina, which has allegedly been withdrawn. There will be no discussion of state property at the session.

As a reminder, in March, the Constitutional Court of Bosnia and Herzegovina considered the requests of the members of the BiH Presidency, Denis Bećirović and Željko Komšić, and two more appeals for the adoption of a temporary measure by which the Court would invalidate the contested Law on Immovable Property of the Republika Srpska until a final decision is made.

At a two-day session, the Constitutional Court of Bosnia and Herzegovina was supposed to consider the request for constitutional review of the provisions of the Law on the Court of Bosnia and Herzegovina submitted by Borjana Krišto, while she was still the Speaker of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina.

The media reported that this item was withdrawn from the agenda because a majority was not required in the Court to accept her request.

In the explanation of the request sent by Kristo, it is stated that the provisions of the Law on the Court of Bosnia and Herzegovina are not in accordance with the Constitution of Bosnia and Herzegovina, the European Convention on Human Rights and Fundamental Freedoms and the provisions of the International Covenant on Civil and Political Rights.

Although the media reported that judge Zlatko Knežević should also be present at the session of the Constitutional Court of Bosnia and Herzegovina, there is no official information about this yet.
