In ruling on the Motion filed by the BiH Prosecutor’s Office to order the accused into continued custody following the confirmation of Indictment, on 21 January 2020 the Court of Bosnia and Herzegovina issued a Decision ordering the accused Adis Abaz into continued custody due to the existence of special custody grounds set forth in Article 132(1), Subparagraphs a) and c), of the Criminal Procedure Code, which is the flight risk and concern that he may repeat or complete the attempted criminal offense.
According to the Decision, pre-trial custody may last for a maximum of 2 (two) years, which means until 21 January 2022 or a new decision of the Courts. If no trial judgment has been delivered during that period, custody shall be terminated and the accused shall be released. Control of justifiability of further custody shall be carried out on a bi-monthly basis.
The Indictment charges the accused Adis Abaz with the criminal offense of Organized Crime under Article 250(3) of the Criminal Code of Bosnia and Herzegovina (CC BiH) as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) of the CC BiH.
