Court of BiH confirms Indictment against Arnautovic and Maglic

On August 11 of this year, the Court of Bosnia and Herzegovina confirmed the indictment in the criminal case against Admir Arnautović, known as “Šmrk” and Adnan Maglić, known as “Magla”, which accuses the defendants of having committed the criminal offense of organized crime, illegal traffic in narcotic drugs, weapons, military equipment, money laundering, and the criminal offense of grievous bodily harm.

Among other things, Arnautović and Maglić are accused of, in the period from December 2019 to the end of 2022, together with other persons known to them, on the basis of a mutual agreement on a joint plan of action, with the aim of obtaining illegal property benefits, in order to commit criminal offenses prescribed by the Criminal Code of Bosnia and Herzegovina and the Criminal Code of the Federation of BiH, organized and became members of an organized crime group, which operated in the territory of Bosnia and Herzegovina, the countries of the European Union and other countries.

They jointly organized and managed the group for organized crime, which was knowingly and voluntarily joined by members A.M., A.K., D.P., E.l., S.M., N.L. and others. The group was formed in order to commit the above-mentioned criminal acts: international traffic in the narcotic drugs Cocaine and Cannabis Sativa L (concentrated resin of Indian hemp – hashish), so, being aware of the prohibition of actions and aware of their actions within the aforementioned group and willing to do so, through mutual connections and agreements, connections and agreements with other persons known to them, they planned, prepared and carried out unauthorized traffic in narcotic drugs, engaged in the international sale and transfer of narcotic drugs, by offering for sale, buying, holding for sale, transporting narcotic drugs, mediated the international sale of narcotic drugs.

They also engaged in unauthorized trafficking in weapons and military equipment whose trafficking without a permit is prohibited or restricted, during which illegal actions the organizers and members of the group used specially configured mobile phones with the “Sky Ecc” application installed, which is intended for protected and encrypted communication.

It is also stated that in order to facilitate the operation of the group and to secure their position as the group’s organizer, the accused prepared, planned and undertook criminal acts of physical violence and extortion, and by connecting with other groups and clans that operated in the region and at the global level, secured a position of power for themselves, and then further used the influence of this position in such a way that they pressured individuals to use their protection services from other criminal groups.

In the confirmed indictment, the defendants are accused of trafficking in at least 5.5 kg of the narcotic drug cocaine, at least 10 kg of the narcotic drug hashish, and at least six firearms, in which way they achieved illegal financial gain in the amount of at least 438,105 BAM, which, in addition to the financial gain in an unknown amount that resulted from other illegal activities of the group, with the aim of concealing its true nature, origin and ownership over property, put into legal cash flows through the purchase of real estate, renovation and construction of residential buildings, purchase of motor vehicles, as well as long movable things of value, both in their own name and in the name of other members of the group or third parties, the Court of Bosnia and Herzegovina announced.
