Court of BiH issued a Decision ordering Pre-trial Custody for Two Persons

Deciding on the Prosecutor’s Motion to order custody of suspects in the case of Adis Abaz et al., on 17 November 2018 the Court of Bosnia and Herzegovina issued a decision ordering pre-trial custody of the suspects Almir Mrkonjić and Sumedin Topčagić. Pre-trial custody was ordered on the statutory grounds set forth in Article 132(1), Subparagraphs b) and c) of the BiH Criminal Procedure Code, which implies the concern that the suspects might destroy, conceal, alter or forge evidence or clues important for the criminal proceeding, hinder the criminal proceeding by interfering with the witnesses, accomplices or accessories, and due to the concern that they may repeat the criminal offense or complete the one already attempted.

According to the Decision, their custody may last until a new decision of the Court, but not longer than one month, running from the day of arrest, which means until 15 December 2018.

Almir Mrkonjić and Sumedin Topčagić are suspected of the criminal offense of Organized Crime under Article 250(3) of the Criminal Code of Bosnia and Herzegovina (CC BiH), as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) of the CC BiH, all in conjunction with Article 54 of the CC BiH.
