At the preliminary hearing, the Disciplinary Prosecutor’s Office (UDT) read the lawsuit accusing the suspended Diana Kajmaković of acting in the investigations of the Prosecutor’s Office of Bosnia and Herzegovina in proceedings related to the “Sky” application.
Disciplinary prosecutor Alena Kurspahić read the lawsuit, which charges Kajmaković, the suspended deputy chief prosecutor, on three counts – using the prosecutor’s office for the purpose of obtaining benefits, interfering with the work of prosecutors, behavior that harms the reputation of the office, as well as other behavior that constitutes a serious breach of official duty or calls into question the public’s trust in impartiality and credibility.
In the first point of the lawsuit, Kajmaković is accused of keeping 21 pieces of confidential information received in connection with “Sky” in her office safe in her capacity as head of the Special Department for Organized Crime of the Prosecutor’s Office of BiH from November 8, 2021 to August 24, 2022. applications, that she did not mislead them in accordance with the Rulebook on Office Operations and that she acted contrary to the request of the Acting Chief Prosecutor.
“There was no reason to keep these documents in her safe to which only she and her associate have access,” said Kurspahić.
Kajmaković was charged that on May 23, 2022, in her office, she told the police officer of Sarajevo Canton in a raised tone that she personally had to deliver documents related to the “Sky” application, and not to the acting prosecutors.
In the third count, she is accused of having invited the prosecutor’s associate Mirza Hukeljić to make a decision for her from his file, which the acting prosecutor did not allow.
The disciplinary prosecutor suggested that Kajmaković be relieved of her duties as a prosecutor.
Senka Nožica, the representative of the defendant Kajmaković, pointed out that none of what was stated in the lawsuit was true and that the defendant left strictly confidential information in the safest place.
“We will prove that she was on sick leave, that she did not keep them without work and unjustified,” announced Nožica.
The UDT suggested that chief prosecutor Milanko Kajganić, prosecutors Mirza Hukeljić, Džermin Pašić and Dubravko Čampara, as well as associates and a police officer, be heard as witnesses.
Kurspahić also proposed material evidence on the provision of confidential information from the safe, changes in team members for dealing with cases related to the “Sky” application, absence of the defendant due to illness. Among the proposed evidence is a letter from the Ministry of Finance of the United States of America, which, according to the prosecutor, speaks about the perception of Kajmaković’s activities.
As new evidence, an act on the handling of documents of the Intelligence and Security Agency (OSA) found in the safe was proposed.
