Indictment issued against Two Persons for Crimes against Humanity

A Prosecutor of the Special Department for War Crimes of the Prosecutor’s Office of BiH has filed an indictment against Radomir Nedić, born in 1943 in Doboj, and Ratko Đurko, born in 1943 in Ugljevik.

The accused are charged with command responsibility, namely that during a systematic and widespread attack on the Bosniak civilian population in the Ugljevik Municipality, the accused Nedić, as Commander of the Army of Republika Srpska (VRS) 1st Majevica Brigade, and the accused Đurković, as Commander of the 1st Battalion of the VRS 1st Majevica Brigade, acted contrary to the provisions of the Geneva Conventions for the Protection of Civilian Persons and Prisoners of War in Time of War.

They are charged that during the attack on the Bosniak civilian population in the area of the village of Tursunovo Brdo in July 1992, when subordinate members of the VRS killed four Bosniak civilians including two women over 60 years of age, they were at the scene as commanders, led the operation, knew and were informed about the crime committed against the civilians through military security services and otherwise, failed to take measures and activities to prosecute the crime, identify the perpetrators and punish them.

Furthermore, the accused are charged that during the capturing and murder of two members of the Republic of BiH Army, who were killed by firearms and cold steel after having been captured by subordinate members of the VRS, they were at the scene and that they knew and were informed about the crime but failed to take necessary measures to prosecute the crime and identify and punish the perpetrators.

The accused are charged with the criminal offence of Crimes against Humanity under Article 172 and War Crimes against Prisoners of War under Article 175, in conjunction with Article 180 (2) of the Criminal Code of BiH.

The prosecution will prove the allegations from the indictment by calling more than 50 witnesses and expert witnesses, and by submitting more than 250 pieces of material evidence.

The indictment was forwarded to the Court of BiH for confirmation.
