Lawyers in BiH are suspending their Work in ex officio Cases

Lawyers from the Federation of BiH and Republika Srpska are suspending their work in cases as of today.

This could mean that the Court of Bosnia and Herzegovina will not be able to hold custody hearings or trials where suspects or accused persons are defended by ex officio lawyers.

Also, it will directly influence the decisions on determining or extending custody or determining prohibitive measures when, according to the CPC, the presence of a defense attorney is necessary.

The Bar Associations from FBiH and RS previously sent a letter to the Court of Bosnia and Herzegovina requesting that trials in cases handled by ex officio lawyers be scheduled once a month, and that otherwise they will immediately make a decision to suspend work.

One of the demands is the payment of arrears of fees for acting on official duty.

The Chambers also sent this letter to the High Judicial and Prosecutorial Council and the State Ministries of Finance and Justice, because lawyers have not been paid their fees for half a year due to the failure to adopt the state budget.

Lawyers from the RS demand that the text of the Tariff on Rewards and Remuneration, which was submitted to the Ministry of Justice of the Republic of Srpska on December 5 of last year, be adopted.
