What did PIC Member Countries say about the latest Decision on Referendum?

2012_nov_30-pic-aOn the occasion of the decision by the Constitutional Court of BiH regarding the temporary prohibitive measure for organization of the referendum in Republika Srpska, countries members of the Peace Implementation Council in BiH issued a press release, inviting the authorities in RS to abolish the scheduled referendum.

“The Constitution of BiH defines that Bosnia and Herzegovina is a democratic country that functions on the foundations of the rule of law. No institution or body of authority in BiH can operate outside of constitutional order. Decisions by the Constitutional Court of BiH must be respected. The powers of the Constitutional Court of BiH are defined in the Annex 4 of the Dayton Peace Agreement, which gives this Court the jurisdiction over settlement of disputes between different levels of authority,” it was stated.

Ambassadors of the Steering Committee of the Peace Implementation Council (PIC) noted that on September 17 the Constitutional Court of BIH decided to suspend the Decision on referendum reached by the National Assembly of Republika Srpska until the reaching of the Court’s decision on its constitutionality.

“Accordingly, there is no legal basis for organization of the entity referendum in Republika Srpska on September 25. Once again, we invite authorities in the RS to intermit the activities related to the referendum,” the PIC member countries stated.

Ambassadors of the Steering Committee of the PIC reiterated that no referendum can change the final and binding nature of decisions reached by the Constitutional Court of BiH.

Steering Committee of PIC urges the political leaders to turn to the solving of economic and social challenges that the citizens of Bosnia and Herzegovina are facing, and which are of crucial importance for the stability of BiH and its European future. Precisely those are the issues of major importance for the country and its citizens; it was stated in the joint statement of PIC member countries, with a note that Russia does not join the statement.
