Why has the Prosecutors Office opened a Conduct Investigation against BiH’s Security Minister?

In accordance with our previous information that the public will be apprised of the activities of the Prosecutor’s Office of Bosnia and Herzegovina following the information issued on 03 April 2019, the Prosecutor’s Office of Bosnia and Herzegovina hereby notifies the public that it has issued an Order for Conducting Investigation against Dragan Mektić.

The Order for Conducting Investigation was issued due to the fact that, while working on this case, the Prosecutor’s Office got hold of several pieces of evidence suggesting the existence of grounds of suspicion that the following criminal offences were committed: Abuse of Office or Official Authority (Article 220 of the Criminal Code of Bosnia and Herzegovina), Disclosure of Secret Data (Article 164 of the Criminal Code of Bosnia and Herzegovina) and Giving False Statements (Article 235 of the Criminal Code of Bosnia and Herzegovina).

Namely, evidence collected so far indicate that grounds of suspicion exist that the aforementioned person, as a responsible person in the capacity of a Minister of Security at the Council of Ministers of Bosnia and Herzegovina, obtained certain confidential data and then shared such data in different ways with persons who are not authorized to access data marked with a degree of secrecy, although he knew that he was obliged to maintain the secrecy of such data, and then he was falsely informing the public and he ultimately gave a false statement to the Prosecutor’s Office of Bosnia Herzegovina, all of which had grave consequences to the security, rule of law and reputation of Bosnia and Herzegovina.

In view of the fact that documents and evidence marked with a degree of secrecy will be used during the investigation, a degree of secrecy will be assigned to this case as well in the period to follow.
