Zoran Malinic quilty of Killing Bosniak Men and Boys from the Srebrenica Enclave

On 16 October 2020 the Court of Bosnia and Herzegovina confirmed the Indictment in the case of Zoran Malinić, charging the accused Zoran Malinić with the criminal offense of Genocide under Article 171, Subparagraphs a) and b), of the Criminal  Code of Bosnia and Herzegovina (CC BiH) as read with Article 180(1) and Article 31 of the CC BiH.

According to the Indictment, during a widespread and systematic attack between 6 July 1995 and 1 November 1995, launched by VRS and MUP RS members against the Bosniak population in the UN Safe Area of Srebrenica, an operation was carried out to permanently and forcibly transfer the entire Bosniak civilian population, capture, incarcerate and kill the able-bodied Bosniak men and boys from the Srebrenica enclave, and organize their burial, excavation and reburial in other locations for the purpose of hiding evidence, which is how a group of Bosniak people was partly exterminated, during which the entire Bosniak population, up to 40,000 Bosniak civilians, were eliminated from the Srebrenica enclave, while more than 8,000 Bosniak men and boys were killed.

As commander of the Military Police Battalion of the 65th Motorized Regiment of the VRS Headquarters, acting on the orders of Ratko Mladić and the officers subordinated to him at the VRS Headquarters, as well as Milomir Savčić, Commander of the 65th Regiment, between 11 July 1995 and 15 July 1995, in the territory of Nova Kasaba (previously Dušanovo) including the elementary school building and the football stadium, knowing of their intention, the accused Zoran Malinić knowingly provided assistance to members of a joint criminal enterprise whose plan was to first capture and then incarcerate and summarily execute and bury able-bodied Bosniak men from the Srebrenica enclave and thus eliminate them as a group, the Indictment reads.
