One Person found guilty of the Criminal Offense of Crimes against Humanity

The Appellate Panel of the Court of Bosnia and Herzegovina, following deliberation and voting, has delivered and on 28 October 2020 announced an appeals judgment in the case of Boro Milojica et al. finding the accused Boro Milojica guilty of the criminal offense of Crimes against Humanity under Article 172(1)a) of the Criminal Code of Bosnia and Herzegovina (CC BiH), as read with Article 180(1) of the Code, and in relation to Count 2 also in conjunction with Article 29 CC BiH. The Appellate Panel sentenced the accused Boro Milojica to 16 years of imprisonment.

The accused Boro Milojica has been found guilty that in the framework of a widespread and systematic attack launched by the army and police of the Serb Republic of BiH, subsequently Republika Srpska, aimed against the non-Serb civilian population in the territory of Prijedor municipality, between June 1992 and September 1992, knowing of the attack and that his actions constituted a part thereof, as a member of the 6th Ljubija Battalion of the 43rd Prijedor Motorized Brigade of the Army of Republika Srpska, in violation of the rules of international law, he committed the killing of civilian population.

The accused Boro Milojica and the accused Želislav Rivić are acquitted of the charges that in the framework of a widespread and systematic attack launched by the army and police of the Serb Republic of BiH, subsequently Republika Srpska, aimed against the non-Serb civilian population in the territory of Prijedor municipality, between June 1992 and September 1992, knowing of the attack and that their actions constituted a part thereof, as members of the 6th Ljubija Battalion of the 43rd Prijedor Motorized Brigade of the Army of Republika Srpska, in violation of the rules of international law they jointly committed persecution of Bosniak, Croat and Romany civilians on account of their ethnic and religious affiliation, by way of killing.

The accused Boro Milojica shall be deprived of liberty immediately, while the time he spent in pre-trial custody shall be credited towards his sentence of imprisonment.
