Court of BiH issues Decision on Judge Peric’s Request for Exemption

At the General Session of the Court of Bosnia and Herzegovina, Judge Branko Perić’s request for exemption from the trial in the “Ventilators” case, in which he is the chairman of the Judicial Council, was rejected, confirmed the Court of Bosnia and Herzegovina to FENA.

“The decision to reject the request for exemption was made for the reason that the conditions from Article 29, paragraph 1, point f) of the CPC of BiH were not met. The aforementioned provision stipulates that a judge cannot perform judicial duties if there are circumstances that cause reasonable doubts about his impartiality,” the Court stated.

Since the Court, based on the mentioned legal provision, determined that there is no objective evidence of Judge Perić’s bias, a decision was made rejecting the request for exemption in this case, with the aforementioned explanation.

As is known, Judge Perić requested exemption in the “Ventilators” case due to, as he stated, “public pressure and threats” sent to him after the acquittal of the first-instance verdict in the case of Zijad Mutap and others (Dženan Memic case).

In the “Ventilators” case, Fadil Novalić, Prime Minister of FBiH, Fahrudin Solak, suspended director of the Federal Civil Protection Administration, Fikret Hodžić, owner of the company F.H. Srebrena malina, as well as the legal entity F.H. Srebrena malina, and Jelka Milićević, federal minister of finance, are on trial, who are charged in connection with with the purchase of 100 ventilators, worth 10,530,000 BAM.
