Interview with the Member of BiH Presidency Zeljka Cvijanovic

The police of Republika Srpska is in the function of protecting the Constitution and the constitutional order, and the staged political process against Milorad Dodik is in the function of destroying the Constitution and the constitutional order, Željka Cvijanović, a member of the Presidency of Bosnia and Herzegovina said.

Cvijanović in the Current Interview BHT1, among other things, talks about the court process against the President of Republika Srpska Milorad Dodik, the decisions of the High Representative Christian Schmidt, the address of the Chairman of the Presidency of Bosnia and Herzegovina Željko Komšić at the session of the UN Security Council, as well as the relations within the current convocation of the Presidency of BiH .

“There are things on which we agree, there are also things on which we have different political views. I would say that there are no big unknowns, but I would also say that there is awareness when something is important for the citizens of the Republika Srpska and the Federation of BiH, then these are things that are easily solved. Whether it is about the ratification of certain agreements, projects that need to be supported and the like, I think there are no problems,” Cvijanović evaluated the work of the BiH Presidency in the past year.

Commenting on the recent address of the Chairman of the BiH Presidency, Željko Komšić, at the session of the UN Security Council in New York, Cvijanović reiterated the position that the content of his address was not agreed upon by the BiH Presidency.

“The very situation that someone is debating at that level of the UN Security Council about a country shows that that country has major flaws and shortcomings. If you add to that the fact that we have a disagreement on whether Christian Schmidt was elected legally or not legally on this position, it is an additional problem for BiH. It points to a series of problems related to this country, which, I claim responsibly, has become a toy in the hands of all those others for a long time, and by no means something that we truly deal with, because we always expect that someone on the side, it arranges and brings certain things. Another dimension is that for many years, positions have been presented there by domestic politicians that were not previously agreed upon as it should be. Some practice of harmonizing positions was abandoned a few years ago. I believe that the institutions that are responsible for conducting foreign policy, such as the Presidency, in order for something to come out on behalf of the Presidency, an agreement should be reached on it. If you don’t have an agreement, then you simply don’t have a position,” Cvijanović is categorical.

The trial of the President of Republika Srpska, Milorad Dodik, is ongoing before the Court of Bosnia and Herzegovina due to non-recognition of the legislative powers of High Representative. In an interview for BHRT, the member of the Presidency of Bosnia and Herzegovina commented on this court process, as well as the statement of the Minister of Internal Affairs of the RS, Siniša Karan, who said that “no one will ever arrest the president of Republika Srpska”.
According to her, a staged political process is being conducted in the Court of Bosnia and Herzegovina, with the purpose of destroying the Constitution and the constitutional order.

“I think that the statement of the Minister of Internal Affairs of the Republika Srpska is very important because the Police of the Republika Srpska is in the function of protecting the Constitution and the constitutional order, and this staged political process is in the function of destroying the Constitution and the constitutional order. It is quite normal that the minister is in that way reacted and that is quite right. We have two parallel processes – one is to defend constitutionality and the other is to attack that constitutionality. Unfortunately, by attacking that constitutionality, you are using and abusing the institutions of the judiciary,” Cvijanović opined.

“Imagine a foreigner comes, whoever he is, and says: If you don’t respect me and my decisions, then you go to prison somewhere, first they will beat you and drag you through some judicial processes. So, there is no such country in the world , and that it can be counted as a civilized part of the world. Bosnia and Herzegovina thereby discredits itself, and that Mr. Schmidt also discredits it, throws it out of the normal flow of civilized countries,” said Cvijanović, with the assessment that the president of Republika Srpska “carried out his Obligations prescribed by the Constitution”.

“You have the president of Republika Srpska who fulfilled his obligations prescribed by the Constitution, and finally the transferred obligation that was given to him by the National Assembly, he just transferred and thus completed a legislative procedure. Now, if this country is normal and legal, and that it is not an experiment and a toy in someone else’s hands, you have clearly prescribed procedures for reviewing certain acts if you do not like them and consider them to be in conflict with the Constitution, but then that brings you into another sphere, so you deal with the issue of the Constitutional Court, so then you see that the Constitutional Court essentially does not defend or protect the Constitution, but rather creates constitutional solutions.

You actually come to a situation where you look at it from the inside and say: What a circus! What do we need all this for? We need a dialogue, but I don’t recognize the need or desire for dialogue. I recognize that there are political structures that are not even politically strong enough to be able to bring it up, even if they want to, and on the other hand, they are used to having a subordinate relationship, to having to listen to some foreigner. I don’t think they are smarter than us. I think that the citizens and officials of both the Republika Srpska and the Federation of BiH, and those at the BiH level, are smart enough, if they want, to solve every problem through dialogue,” said, among other things, a member of the Presidency of BiH Željka Cvijanović in an interview for BHRT .
