The Constitutional Court of BiH on the last session rejected the request of the National Assembly of the RS for review of the decision which confirmed that the 9th of January, the Day of the RS, is considered as unconstitutional.
Although politicians from the FBiH invited and expected the High Representative Valentin Inzko in this case to reach for the Bonn powers as Brcko Supervisor, Mr. Bruce Berton, did, this will not happen after all.
“There is no need to use the executive powers of the High Representative in case of a referendum in the RS, since the Constitutional Court of BiH issued a temporary suspension of the decision to call a referendum and therefore there is no legal basis for holding the referendum. Following the decision on temporary suspension, the Commission for the referendum in the RS has no mandate to organize a referendum which was suspended. The High Representative invites all competent authorities to ensure compliance with this decision, and reminds all authorities that the violation of the decision of the Constitutional Court of BiH is a crime,” as announced from the Office of the High Representative in BiH.
The Constitutional Court of BiH declared the Day of the RS as unconstitutional, after which the National Assembly of the RS made a decision to hold a referendum on the 25th of September. A referendum will ask the citizens to take a stand on whether the 9th of January should be marked and celebrated as the Day of the RS.
The Constitutional Court previously accepted the Chairman of the Presidency of BiH, Bakir Izetbegovic, for a provisional measure to suspend the decision to call a referendum in the RS.
