The Session of the House of Peoples of the BiH Parliament has begun

The House of Peoples of the Parliamentary Assembly of Bosnia and Herzegovina is scheduled to consider the Draft Law on the High Judicial and Prosecutorial Council (HJPC) of BiH and the Draft Law on Amendments to the Law on the Court of BiH at an urgent session that has begun.

The proponents of these laws are members of the Collegium of the House of Peoples: Kemal Ademović, Dragan Čović and Nikola Špirić. These are two draft laws whose adoption is one of the conditions for the opening of BiH negotiations with the European Union.

The proposed laws should be considered by the delegates in the first reading (principles), in an abbreviated procedure.

The Speaker of the House of Peoples, Kemal Ademović, previously stated that the delegates would consider the version of the law that the Council of Ministers of BiH did not accept, and that was proposed by the Ministry of Justice of BiH, “because the profession says that it is the closest to a good solution”.

“The profession says that it is the closest to a good solution, because the Law on the Court does not change the seat, nor does it affect the jurisdiction,” stated Ademović.

He adds that these laws will be considered in a shortened procedure, and that the possibility of amending them will also be left.

“In my contact with the profession, they said that these laws are almost acceptable at this stage of building the judicial system, or rather, improving it. According to this law, the seat remains in Sarajevo, the jurisdiction is not affected, and that is what satisfies the profession. When it comes to the law on the High Judicial and Prosecutorial Council, there are a few more objections. However, there will be an amendment phase in which we will be able to improve this law,” Ademović said at the time.

Yesterday, at an emergency session, the House of Representatives of the Parliamentary Assembly of BiH adopted, in the first reading and in a shortened procedure, the Proposal for a Law on the High Judicial and Prosecutorial Council of BiH, which was proposed by MPs from the opposition parties from the RS: Darko Babalj, Branislav Borenović, Mira Pekić, Nenad Grković and Mladen Bosić.

The House of Representatives adopted the negative opinion of the Constitutional and Legal Committee on the Draft Law on Amendments to the Law on the Court of BiH, which was proposed by the same group of representatives. In accordance with the Rules of Procedure, the adoption of the negative opinion of the Constitutional and Legal Committee means that this draft law is considered rejected.
