Member of Bosnian Border Police allowed Entrance to Foreign Nationals for 20 Euros

On 18 March 2020 the Court of Bosnia and Herzegovina confirmed the Indictment in the Kenan Nikontović case, charging the accused Kenan Nikontović with the criminal offense of Accepting Gifts and Other Forms of Benefit under Article 217(2) of the Criminal Code of Bosnia and Herzegovina (CC BiH).

The Indictment alleges that on 13 July 2019, at the international border crossing of Brod, in his capacity as a police officer with the BiH Border Police, performing the duties of border control at the entrance into BiH, during the check of a p.m.v. make Peugeot Partner with Dutch license plates, the accused Kenan Nikontović requested a gift from the driver and his wife in order to let them cross into the territory of BiH, although being aware, having conducted the necessary checks, that they meet the conditions for entrance into the territory of Bosnia and Herzegovina.

Having received a banknote of 20 EUR, he allowed them to cross into the territory of BiH, whereby he, as an official person at a BiH institution, requested and received a gift to perform, within the scope of his duties, something he ought to perform anyway.
