Indictment confirmed charging Slobodan Curcic with Crimes against Humanity

On 18 September 2018 the Court of Bosnia and Herzegovina confirmed the indictment charging the accused Slobodan Ćurčić with the criminal offense of Crimes against Humanity under Article 172(1), Subparagraphs a) and g), all as read with Article 180(1) of the Criminal Code of Bosnia and Herzegovina (CC BiH).

The indictment, inter alia, alleges that between early April and late September 1992, during a widespread and systematic attack launched by military, para-military and police forces of the so-called Serb Republic of BiH, subsequently Republika Srpska, aimed against the Bosniak civilian population of the Foča municipality, knowing of the attack and that his actions constituted part of the attack, as a member of the armed forces of the so-called Serb Republic of BiH, subsequently Republika Srpska, Slobodan Ćurčić committed murder of civilians, as well as rape against a woman, using force and the threat of force.

On 4 January 2019, the Court of Bosnia and Herzegovina confirmed the indictment charging the accused Saša Ćurčić with the criminal offense of Crimes against Humanity under Article 172(1)g), all as read with Article 180(1) of the Criminal Code of Bosnia and Herzegovina (CC BiH).

The indictment, inter alia, alleges that between 3 July 1992 and 18 July 1992, during a widespread and systematic attack launched by military, para-military and police forces of the so-called Serb Republic of BiH, subsequently Republika Srpska, against the Bosniak civilian population of the Foča municipality, knowing of such an attack and that his actions constituted part thereof, as a member of those forces Saša Ćurčić acted in violation of international humanitarian law, specifically common Article 3 of the Geneva Conventions of 12 August 1949, by force, together with other persons, a woman to intercourse or an equivalent sexual act (rape).
