Member of BiH Presidency met with HR Christian Schmidt

The member of the BiH Presidency, Denis Bećirović, at the OHR headquarters, spoke with the high representative in BiH, Christian Schmidt, about the current situation in Bosnia and Herzegovina.

Bećirović emphasized that in the current circumstances it is most important to protect the constitutional order of Bosnia and Herzegovina and stop the destructive separatist policy of the authorities of the RS. He said that the international community should act as soon as possible to stop the undermining of the foundations of the Dayton Peace Agreement and the Constitution of Bosnia and Herzegovina.

Member of the BiH Presidency, Bećirović, informed Schmidt about the details of the law on state property, which was referred to the BiH Presidency for procedure yesterday.

He said that the fundamental basis for the adoption of this law is contained in Annex 4 of the Dayton Peace Agreement, the Agreement on succession issues of the former SFRY and the final and binding decisions of the Constitutional Court of BiH.

Bosnia and Herzegovina, as the legal successor of the Republic of Bosnia and Herzegovina, is the holder, and consequently, the holder of ownership rights, on all state property. Entities and other levels of government can use those assets that are necessary for the exercise of their individual competences, to the extent that they are authorized by the law passed by the Parliamentary Assembly of BiH.

During the conversation, Bećirović pointed out that state property reflects statehood, independence, sovereignty and territorial integrity that belong exclusively to the state of Bosnia and Herzegovina, not to the entities. He said that the state of Bosnia and Herzegovina, like all other UN member states, must have all the prerogatives of an independent and sovereign state, including state property.

In the end, Bećirović pointed out that the law on state property is based on the principles of the rule of law, according to which Bosnia and Herzegovina as a rule of law guarantees its citizens legal security, which is an important principle of Bosnia and Herzegovina’s legal system, Fena reports.
