Representatives from the Federal Ministry of Agriculture, Water Management and Forestry; the Federal Ministry of Energy, Mining and Industry; the State Attorney’s Office of BiH; the Office of the High Representative (OHR); the Government of the Zenica-Doboj Canton and relevant cantonal ministries; the Municipality of Vareš; and other government institutions met today at the FBiH Government headquarters in Sarajevo. The meeting addressed a decision by the Constitutional Court of BiH regarding the disposal of state-owned forest land in Vareš.
The meeting was organized to coordinate the activities of the competent authorities and to conduct a comprehensive analysis of the adoption procedures—as well as the compliance—of the contested acts with the Law on the Temporary Prohibition of Disposal of State Property of Bosnia and Herzegovina.
“In the aforementioned decision, the Constitutional Court of Bosnia and Herzegovina instructed the competent institutions—including the Federal Ministry of Agriculture, Water Management and Forestry—to review whether acts falling under their jurisdiction are in compliance with the said Law. This process must involve the State Attorney’s Office of Bosnia and Herzegovina. Furthermore, the institutions are required to take steps to repeal any acts found to be inconsistent with the legal provisions,” stated the Federal Ministry of Agriculture, Water Management and Forestry.
It was further noted that the meeting included a review of the situation on the ground, the actions taken to date by the competent authorities based on individual acts, and potential legal and institutional approaches to ensure the implementation of the Constitutional Court of BiH’s decision. Special emphasis has been placed on the need for mutual cooperation and coordination among all competent institutions, while respecting legal mandates and the obligation to protect the interests of Bosnia and Herzegovina and the Federation of Bosnia and Herzegovina.
“The Federal Ministry of Agriculture, Water Management and Forestry underscores the importance of an institutional and responsible approach to this issue; within the scope of its competencies, it will continue efforts to review the acts in question and take appropriate measures, in accordance with the ruling of the Constitutional Court of BiH and applicable regulations,” the Ministry stated.
The shared objective of all involved institutions is to ensure lawful conduct, the consistent implementation of the rulings of the Constitutional Court of Bosnia and Herzegovina, and the protection of state property of BiH, according to a statement from the Federal Ministry of Agriculture, Water Management and Forestry.
