HR Schmidt: The Law cannot prematurely end the Mandates of foreign Judges

On the occasion of possible new legal solutions regarding the election and status of foreign judges of the Constitutional Court of Bosnia and Herzegovina (BiH), High Representative Christian Schmidt spoke.

Yesterday, High Representative Christian Schmidt pointed out that according to the Constitution of BiH, international judges in the Constitutional Court of BiH are appointed by the President of the European Court of Human Rights.

He added that foreign judges serve until they reach the age of 70 unless they themselves resign or are dismissed for justified reasons, with the consent of other judges.

“Similarly, according to the Constitution, the law adopted by the Parliamentary Assembly of BiH can change the method of appointing international judges, but it does not have the authority to prematurely end their mandates in order to replace them with domestic judges,” concluded Schmidt, Klix.ba reports.
