Sarajevo Prosecutor’s Office Awaits Court Decision on Indictment Against Tram Driver

The Prosecutor’s Office of Sarajevo Canton announced that it is still waiting for the court’s decision on the indictment brought against Adnan Kasapović, the tram driver, while in relation to the other allegations included in the case, an order was made not to conduct an investigation.

The Prosecutor’s Office of Sarajevo Canton announced that, after conducting checks and analyzing the collected evidence, it issued an order not to conduct an investigation in the part of the case that related to allegations from an anonymous report and media articles about the servicing of magnetic brakes, the video surveillance system, and marketing contracts for the lease of advertising space in tram vehicles.

As stated, the checks established that the reported acts in that part do not constitute criminal acts, which is why there were no legal conditions for initiating an investigation.

At the same time, the KS Prosecutor’s Office emphasizes that the proceedings against Adnan Kasapović are being conducted in the second part of the case. An indictment was brought against him for a serious criminal offense against the safety of public traffic and endangering public traffic, and the Prosecutor’s Office is currently waiting for the court’s decision on that indictment.

It will publish an anonymized command

The KS Prosecutor’s Office states that no complaint was filed against the decision not to conduct an investigation.

However, bearing in mind the public’s interest in this case, as well as the need to provide clear and complete information about the actions of judicial institutions within the framework of legal possibilities, the Prosecutor’s Office decided to make available to the public an anonymized order not to conduct an investigation.

The document will refer to the part of the case that included additional checks, i.e. statements related to the servicing of magnetic brakes, video surveillance and contracts for the lease of advertising space in trams.

In this way, as stated by the Prosecutor’s Office of the KS, the public will be able to learn directly about the reasons why there were no legal conditions for starting an investigation in that part of the case.

Protection of personal data

The prosecution pointed out that the order will be published in an anonymized form.

Parts of the document will be anonymized where necessary for the application of the Personal Data Protection Act, i.e. the protection of data whose publication is not permitted.

The Sarajevo Canton Prosecutor’s Office says that the goal of publishing the document is to provide more transparent information to the public about the actions taken and the decisions made, while at the same time respecting legal restrictions and protection of personal data.

The proceedings on the indictment against Adnan Kasapović, as stated, remain within the competence of the court, whose decision the KS Prosecution is still waiting for, the KS Prosecution announced.
